Arnold & Itkin recently represented a young woman who had sustained injuries in a serious accident involving an 18-wheeler truck. The client, a resident of Houston and veteran of the armed forces, was in need of back surgery as treatment for her injuries. In spite of this surgery, the defense argued that the victim's injuries were pre-existent to the accident and that her claim was simply to obtain money to pay for the surgery.
The defense's arguments were not convincing to the judge, Honorable Wesley Ward of Harris County. Despite attempts to escape liability, the negligent party responsible for the accident and the injuries eventually accepted liability. In the midst of the trial, the two opposing parties negotiated a fair settlement of $950,000 in favor of Arnold & Itkin and their injured client.
