According to the plaintiff the driver committed negligence and gross negligence and Rush Waste Services is vicariously liable. The plaintiff is seeking compensation of more than $200,000 but less than $1 million.

Types of Dump Trucks

Dump trucks are used to carry material in and around construction sites.

Types of dump trucks include:

  • Articulated Hauler
  • Bottom Dump Trailer
  • Double and Triple Trailer Bottom Dump Truck
  • Semi Trailer End Dump Truck
  • Side Dump Truck
  • Standard Dump Truck
  • Superdump Truck
  • Transfer Dump Truck
  • Truck and Pup

What Makes Dump Trucks Dangerous

These large, heavy (weighing up to 80,000 pounds and carrying up to 280,000 additional pounds) vehicles can cause life-threatening injuries when they collide with a passenger car. Because the dump truck driver sits at a much greater height than the driver of the passenger vehicle, he usually escapes harm.

Common causes of dump truck accidents include:

  • Backing Up: Due to visual limitations, a dump truck driver can miss seeing an oncoming vehicle or a parked vehicle.
  • Tipping: Because dump trucks tend to be large, heavy and unbalanced, they are highly susceptible to tip overs.

In addition to being large, a dump truck usually is carrying hazardous materials, which makes a collision even more dangerous. When a passenger vehicle and a dump truck collide, the dump truck's height can cause the passenger vehicle to go underneath the dump truck—which can cause all kinds of serious injuries. The weight and construction of the dump truck can make all other vehicles crumple on impact.

Common injuries sustained in a dump truck accident include broken bones, spine injuries, traumatic brain injuries, crushed/lost limbs, lacerations and back and neck injuries. In some cases, the occupants of the passenger vehicle even suffer death.
