Defendants arguing on behalf of Scorpion Transport and the Scorpion Transport insurance provider claim that Berryman's doctor records show that she had herniated discs in her lower back and neck as early as 2007. The accident occurred in December of 2010. As the two parties battled back and forth, they agreed to meet with a mediator to work through the issues of the case. The out-of-court meeting resulted in a mediator's proposal, but both parties rejected the settlement amount as unfair. At the second mediation meeting, attorneys from Arnold & Itkin were able to prove that Scorpion Transport was at-fault for the accident and needed to reimburse Berryman.
The firm succeeded in getting a $565,000 settlement for Berryman. This is more than the original amount that was suggested in the first mediation.
